1. Information about Us

Hopohomes.com (the “Website”) is a website operated by Hopo Homes Technologies FZ-LLC (also referred to as “we” or “us”). We are a Free Zone Limited Liability Company, registered with the Dubai Creative Clusters Authority, with a registered office and main address at In5 Innovation Centre Boutique Villa #7, Al Sufouh Road - Dubai Internet City, Dubai, UAE  – 73000.

2. Acceptance

2.1 By accessing the Website, you thereby accept the Terms and Conditions set forth herein, all applicable laws and regulations and the associated amendments, and to be bound to such conditions and regulations for the duration of usage of the Website. If you dispute or contest any of the above-mentioned, you are prohibited from accessing and/or using the Website.

2.2 It shall be your sole responsibility to review the Terms and Conditions periodically. Should you not accept any Term and Condition mentioned herein or any amendment hereto, you are obligated to immediately discontinue in using and accessing this Website.

2.3 We may at any point amend these Terms and Conditions with or without notification. If we decide to send notification for one update, that in no way obligates us to send subsequent notifications for further amendments and/or updates.

2.4 We may provide a translation of these Terms and Conditions for ease of reference for viewers. Should such translations be provided, you hereby agree to the governing of the English version over any other language. Any contradictions and/or inconsistencies between the English version and any other version, the Terms and Conditions set forth in the English versions shall prevail.

2.5 You hereby agree that by accessing this Website, you are an age of majority as per the laws of the United Arab Emirates. Minors, as per the United Arab Emirates law, are prohibited from accessing, becoming a Subscriber, or publicizing any property on the Website.

2.6 The legal responsibilities and liabilities of the Website are excluded or limited; you take on risk, responsibilities and liability and any rights you have against the Website and/or Us are limited or excluded. You are responsible to thoroughly read through these terms and conditions for upon accessing and utilizing the Website, you are unable to deny the truth of the statements. We, or other persons if applicable, may have claims and other rights against you as a result of the terms stated herein.

2.7 We do not endorse any content or any opinion, statement, recommendation or advice expressed therein, and, as far as the law allows, we expressly disclaim any and all liability in connection with user content. We do not permit copyright infringing activities and infringement of intellectual property rights on the Website, and we may, at our sole discretion, remove any infringing content.

3. Limitation of Liability

3.1 We hereby pledge to do all that we can to maintain and upgrade the Website to the best of our ability. Despite our efforts, we can neither guarantee the accessibility nor the workability of the Website at all times. The materials appearing on our website may include technical, typographical, or photographic errors. We do not warrant that any of the materials on its web site are accurate, complete, or current To fulfill our commitment to you, we shall upgrade and maintain the Website whereby potentially resulting in the unavailability of the Website at some points. We accept no liability for any interruption or loss of service. We reserve the right to alter, discontinue or suspend the Website, as a whole or any part thereof, including your access to it. The Website will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the laws of the United Arab Emirates. Multiple shipments may result in multiple postings to the cardholder’s monthly statement.

3.2 We offer a service of Featured Ads whereby users may pay a non-refundable fee to have their ads posted in selected locations on the Website, thus potentially increasing an ads’ visibility. In order to purchase a Featured Ad, you may be required to transmit certain information through a third party service provider, Click & Buy, a Third Party Website, which may be governed by its own terms of use and other policies. We make no representation or guarantee as to the safety or security of the information transmitted to any Third Party Website, and your linking to any Third Party Website is completely at your own risk, and we hereby discharge ourselves from any and all liability associated with any ad on the Website.

3.3 If you are either the owner of intellectual property rights or an individual fully authorized to act on behalf of the owner of intellectual property rights and notice the intellectual property being unlawfully used and/or displayed on the Website, you may send a notification via email at info@hopohomes.com mentioning the following:

a. The legal right to such intellectual property,

b. The exact intellectual property that is being unlawfully used,

c. Contact information of the complainant, including the complainant’s signature, and

d. A signed statement claiming the information given is true and accurate.

3.4 You hereby agree to indemnify, defend and hold us harmless and any other affiliate against any liability, claims, damages, expenses in relation to any and all violation you have caused related to the Website, any third-party rights or any intellectual property rights. This obligation shall survive the termination, modification and/or expiration of this Terms & Conditions.

4. Governing Law

4.1 These Terms and Conditions, and the relationship between us and you, are governed exclusively by the laws of the United Arab Emirates as applied in the Emirate of Dubai, irrespective of any conflicts of laws issues. Any claim against us shall be under the exclusive jurisdiction of the Dubai Courts.

www.hopohomes.com subscribers are licensed real estate agents, developers, lawful owners, lawful sub-letters of the listed properties and hotel apartment providers. Our advertisers are contractually obligated to only list properties that meet our standards and are available for lease with the proper authority from the owner. Properties listed on www.hopohomes.com should be a fair and accurate portrayal of the property itself and the proposed transaction. To report any sub- standard, suspected fraudulent or misleading property postings on our site please send us an email with the details to info@hopohomes.com

4.2 In case we choose not to exercise our rights against anyone accessing and/or utilizing the Website, it shall not be considered a waiver of rights, rather such right shall be preserved and may be exercised at a later time.

4.3 If any provision herein is deemed illegal and therefore unenforceable, such provision shall be severed from the remaining provisions set forth herein and the remaining provisions shall be fully enforceable, while maintaining the overall intent agreed upon by the parties.

4.4 Should you choose to bring forth a claim to the applicable jurisdiction, you hereby unequivocally agree to bring forth such claim within a reasonable period of time. In any event, such claim should not be brought any time exceeding one (1) year after the cause of action accrues.

5. Intellectual Property Disclaimer:

5.1 The materials on this Website, excluding content posted by any third-party, Subscriber and Advertiser, including but not limited to, the text, software, script, graphics, photos, sounds, music, videos, interactive features, trademarks, service marks and logos (“Content”), are either owned by or licensed to Us and are subject to all laws governing Intellectual Properties within the United Arab Emirates, foreign laws and international conventions. Any and all users are strictly prohibited from reverse engineering, decompiling, or disassemble such goods. All Content displayed on the Website are provided to you AS IS and may not be used for copying, reproduction, distribution, displayed, sold or licensed for any other purpose. Any reproduction, modification, creation of derivative works from or redistribution of the Website, the Materials, or the collective work or compilation is expressly prohibited. Copying or reproducing the Website, the Materials, or any portion thereof for further reproduction or redistribution is expressly prohibited. By utilizing and accessing the Website, you hereby agree not to do any of the acts mentioned above.

5.2 You hereby authorize the Website to collect certain information through technology like cookies, pixels, and local storage. We may allow third parties such as advertising or analytics providers to collect information using these types of technologies directly on our website or from our mobile application. The data that they collect is subject to the applicable privacy policy of those third parties. This collected information may be utilized and shared with affiliates and/or any third-party of our choosing. 

USERS TERMS AND CONDITIONS

6.     Description of Service 

6.1    We offer our users an online medium of connecting potential tenants such as executive bachelors with landlords, agents or suitable roommates. We are neither developers nor brokers nor are we acting on behalf of any entity. We are a neutral third-party providing an advertising space for individuals, or corporates whether natural or legal, to publicize themselves, for purposes of availability of their properties.  We do not specifically endorse any property, product or any service provided by any entity.
 

6.2    The Website may contain links that shall direct users to the third-party website. You agree that we are not liable for any content displayed or publicized on any third-party website. Upon accessing any third-party website, you shall be bound by the terms and conditions associated with that website. You hereby release us from any and all content and/or information related to any third-party website.  

6.3    By utilizing and accessing the Website, you hereby agree that we are in no way associated directly with any other User and/or Advertiser on the Website. We hereby are released from any and all liability associated with any and all transactions made between any two or more parties utilizing the Website. 

6.4    You understand and hereby unconditionally agree that we are not liable for any misrepresentation, misinformation, loss or damage of any kind, miscalculation or any discrepancy regarding any advertisements and/or any user on the Website. We try to ensure that the standards mentioned on our website are always met. However, we do not GUARANTEE that these standards will always be there. In case you observe that actual property is very different from what is shown in the Ads, you can always come back and provide us with a feedback at info@hopohomes.com or can click on "Report Inappropriate" button provided on every property details page. You are solely responsible and liable for obtaining and confirming the credibility of information on the Website. You the user of this Website must conduct your own due diligence and must not completely rely on the details in the advertisements. Any interaction between any two or more parties from the Website, whether directly or indirectly linked to us, is at the sole discretion of the parties.     

7.    Utilization and Access to the Services 

7.1    The Website has been designed to be accessible for any and all individuals visiting, but such access is limited without a subscription. Visitors are able to browse the Website and see advertisements and ads, but unable to click and obtain further information on such publications. You hereby agree to such limited access without any subscription; whereby, releasing us from any loss and/or damages as a result of such limited access.  

7.2     We offer our users the ability to become subscribers to the Website by making the applicable payments in accordance with section (7) herein. Upon compliance with section (7), you will be granted a license to utilize the Website in accordance with the Terms and Conditions set forth herein. Subscribers will create a personal username and password for their own usage on the Website. You unequivocally agree to insert only your own personal information, and not the information of any other individual without that individual’s written consent, and to utilize your personal username and password for your own benefit and not for the benefit of others.  

7.3    Subscribers shall be privileged to access detailed information, given to us, regarding advertisements publicized on the Website. Such additional information may direct subscribers to third-party websites.  (Please refer to clause 5.2 herein regarding liability on third-party websites)    

7.4    Subscribers are requested to disclose basic information about him/her to us for internal purposes only. Should the subscriber refuse to input the requested information, the subscriber may be denied access to the Website. You hereby agree to release us from any and all liability associated with the input and accuracy of the basic information provided. Please refer to our Privacy Policy for more information. 

7.5    The license given to subscribers shall be limited, revocable and non-exclusive. Your license may be revoked at any time at our discretion. We shall revoke any and all licenses of subscribers that breach any clause set forth herein. You hereby agree that we shall have the sole discretion as to whether or not such revocation should last permanently or temporarily and the extent of such revocation. All licenses provided by Us shall not be assignable without the consent of Us. 

8.    Payment for Services 

8.1    Users shall have the option of becoming a subscriber whereby allowing the user a greater access to information and advertisements throughout the Website. To become a Subscriber, the website provides different plans and the user shall pay a fee in the range of AED 19/- to AED 699/- for the defined terms of 15 to 30 days depending on the type of plans available on the website. You may not terminate this subscription before the end of this year under any circumstances. 

8.2    You hereby agree that the Website shall only accept payments made by either Visa or MasterCard credit cards in AED (or any other currency) through the online payment system. The Website shall be released from any liability regarding the malfunctioning, inaccessibility or error as a result from the use of the online payment system. 

8.3    If you make a payment for our products and/or services on our Website, the details you are asked to submit will be provided directly to our payment provider via a highly encrypted and secured connection.    

8.4    One week before the expiry of the license, you will receive a notification from us asking if you would like to renew your subscription to the Website. You will have the entire 7 days to pay the fee associated with the subscription.  Should you either fail to make the payment within the time period given or choose not to renew the license, your subscription will automatically be renewed.

8.5    Subscribers are completely held responsible for maintaining a copy of any and all transaction records generated by the Website.

9.    Prohibitions 

9.1    As a user of this website you unambiguously agree not to utilize the Website or any of its resources for any unlawful purpose under the laws of the United Arab Emirates and any other jurisdiction whereby properties on the Website may be located. 

9.2    You are strictly prohibited from utilizing the Website for advertising any property without fulfilling the obligations set forth in these Terms and Conditions. Furthermore, we do not endorse any copyright and/or intellectual property infringement. Should we determine such activities have or are taking place on the Website, we shall at our own discretion remove any such material and revoke any further licenses obtained by the Subscriber. 

9.3    Any and all content uploaded onto the Website shall comply with the laws of the United Arab Emirate, including but not limited to the content, personal information, software used to access such Website, and the amount of material uploaded.

ADVERTISERS TERMS AND CONDITIONS 

10.    Procedures for Advertising 

10.1     The Website has been developed to consider owners, brokers, sub-leasers and individuals (the “Advertiser”) to publicize their properties to our Users and Subscribers. These publications shall differ between our Users and Subscribers, whereby the Subscribers shall be able to access vital information pertaining to the advertisement while the former will get the basics. 

10.2     Advertisers shall only be able to advertise their respective properties on the Website when they agree to abide by the following obligations: 

10.2.1   For Agents/ Brokers:

  1. You warrant that you possess a valid permit issued by the Dubai Real Estate Regulatory Agency or its equivalent demonstrating legal ability to advertise any and all properties located within the Emirate of Dubai and abide by any other regulation implemented to advertise properties in any other Emirate.
  2. You warrant that in case you are engaged in subleasing activities, you possess a license for the activity of “Leasing and Management of Other People’s Property” from both Dubai Department of Economic Development (DED and RERA);
  3. In case you are engaged in short-term or Holiday Home leasing, you warrant that you possess a license for the activity from Dubai Tourism and Commerce Marketing (DTCM);
  4. As per the RERA regulations, you must obtain approval for leasing advertisement (located within or outside of Dubai) and display the RERA Permit Number, Office Registration Number and Broker Registration Number on all advertisements.

10.2.2   For Owners and Landlords

  1. You certify that you are the Owner/Landlord of the property, or otherwise possess valid authorization to list the property on this Website;
  2.  In case you are engaged in short-term or Holiday Home leasing, you warrant that you possess a license for the activity from Dubai Tourism and  Commerce Marketing (DTCM);

 

10.2.3   For Tenants / Sub-Letters

  1. You certify that you possess valid, written consent from your Landlord before advertising on this Website and that you are legally entitled to publish such advertisement.

 

10.2.4   For All Advertisers

  1. You may only advertise properties that are currently available for lease. We tend to list only those properties which meet our standard criteria’s mentioned on the homepage of the website. Further, it is at our sole discretion to not to list any new property or remove any listings (advertising fees will not be refunded);
  2. You certify that the advertisement does not contain the use of unlawful language or use of the premises, including:
    1. Offensive, distorted or misleading statements;
    2. Sharing of a property that exceeds legal occupancy limits defined by different authorities  (including, but not limited to, bachelor accommodations);
    3. Sharing of a property between unrelated members of the opposite sex as per Tawajed clause of Sharia Law.
    4. Providing property for bachelors in family defined areas defined by Dubai Municipality time to time.
    5. Sharing of a property in any other way that is deemed unlawful;
    6. Any other language that promotes illegitimate or immoral activities under the laws of the UAE.

11.    Payment  

11.1    To be an Advertiser, an individual must make a payment for a license to advertise on the Website for 15 or 30 days (depending on the type of plan).  You may not terminate this subscription before the end of this year under any circumstances.

11.2    You hereby agree that the Website shall only accept payments made via Visa or MasterCard credit cards in AED (or any other currency) through the online payment system. The Website shall be released from any liability regarding the malfunctioning, inaccessibility or error as a result from the use of the online payment system.  As far as the law allows, you use the Service and the Website at your sole risk and responsibility.

11.3    If you make a payment for our products and/or services on our Website, the details you are asked to submit will be provided directly to our payment gateway provider via a secured connection.    

11.4      Three (3) days before the expiry of the license, you will receive a notification from us asking if you would like to renew your license to the Website. You will have the entire 3 days to pay the fee associated with the license or to cancel the license subscription.  Should you either fail to make the payment within the time period given or choose not to renew the license, your license will automatically be renewed and your access to the Website will be defined as per the renewed user plan.

11.5    Advertisers are responsible for maintaining a copy of any and all transaction records generated by the Website. 

12.     Prohibitions 

12.1    You as a user of the website hereby agree not to advertise or post duplicate properties onto the Website or advertise properties that are not in the demographical location covered by the Website. You hereby accept the immediate removal of such advertisements without a refund of any payment made. Should an advertisement be removed by us, you unconditionally agree not to re-advertise the same property on the Website unless written authorization has been given by us.

12.2    You are prohibited from advertising anything false, misleading and/or deceptive on the Website, with or without actual knowledge that violates any law or regulations. We hereby reserve the right to remove such advertisements from the Website and revoke the Advertiser’s complete license for advertising any property on the Website. 

12.3    Advertiser is prohibited from providing us documentation, detailed in clause (10.2), that is neither true nor accurate. Such actions may lead to the complete prohibition of utilizing the Website and potentially legal implications, as per the law of the United Arab Emirates. 

12.4    You are strictly prohibited from advertising any property on behalf of a third-party. Any and all properties advertised on the Website shall be solely under the name mentioned on the permit issued by the Dubai Real Estate Regulatory Authority (detailed in clause (10.2).  

13.    General 

13.1    Any information and/or lead provided to you through our Website is solely your responsibility to verify its accuracy and usefulness. We hereby disclaim, and you hereby waive any rights associated thereto, any liability associated with any false, misleading, deceptive, offensive, objectionable or defamatory information presented to you. 

13.2    Accessing and utilizing the Website, you hereby agree that these Terms and Conditions supersede any and all prior understandings, proposals, agreements, negotiations and discussion, whether written or oral. 

13.3     All ad licenses provided by Us shall not be assignable without the consent of Us

13.4    Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.

13.5     United Arab Emirates is our country of domicile.

 

13.6   Minors under the age of 18 shall are prohibited to register as a User of this website and are not allowed to transact or use the website.

 

13.7   If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.

 

13.8  The cardholder must retain a copy of transaction records and Merchant policies and rules.

13.9  We accept payments online using Visa and Master Card credit/debit card in AED.

13.10 The Website will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the laws of the United Arab Emirates

 

REFUND/RETURN POLICY

 

  1. Hopo Homes may charge a fee/service charge to post Content in some specific areas of the Service (Paid/ Featured Content). Such service charges permit Paid Content to be posted in a designated area of the Website. Each party posting Paid Content to the Service is responsible for the Content and compliance with the Terms mentioned above. Any such fees paid hereunder are non-refundable in the event that any Content is removed from the service for violating these Terms. However, in case the user does not meet the standard defined by Hopo Homes as also mentioned on the homepage of the website then in such cases the featured/paid ads will not be approved by the website administrator and Refunds will be done only through the Original Mode of Payment.
  2. All property ads that announce multiple spaces in one ad will be deleted after 12 hours of their posting and no refund will be given. Within the first 12 hours of the posting, the user can edit the multiple-spaces ad to reduce it to one vacant space. If the ad does not get edited to fulfill Hopo Homes requirements, the ad will be deleted and no refund will be given. To avoid any confusion, multiple spaces in a single house is not covered under this clause however multiple spaces in different flats in the same building or across different buildings in same/different areas are covered under this clause.
